State law or federal law?

Two minimum wage laws apply in Indiana, and both set the same $7.25 rate.

Most Indiana employers are covered by the federal FLSA . Workers the federal law doesn’t reach may still be covered by the Indiana Minimum Wage Law [1]. The state law applies to employers with two or more employees [2].

Under either law, employers have to pay at least the minimum for every hour worked and time and a half after 40 hours in a workweek. Indiana’s law lists many exceptions to the overtime rule [1].

Indiana employers covered by the state law must also give each worker a statement of hours worked, wages paid and deductions taken. The law also bans paying workers differently because of sex [1].

Tipped workers

An employer that claims a tip credit can pay as little as $2.13 an hour in cash [1][3]. It can count up to $5.12 an hour of tips toward the $7.25 minimum [3]. A tipped employee is someone who gets more than $30 a month in tips [3].

If your tips plus the cash wage come up short of $7.25 for the hours you worked, your employer has to pay the difference [1].

The training wage

Indiana lets employers pay $4.25 an hour to workers under 20 for their first 90 consecutive calendar days with that employer [1]. After the 90 days, or once the worker turns 20, the regular minimum applies.

If you’re paid less than you’re owed

1. File a wage claim with the state. The Indiana Department of Labor’s Wage and Hour Division takes wage claims online [5]. You can also email wagehour@dol.in.gov or call (317) 232-2655 [1]. Some claims take as long as 90 days to resolve [5].

The department won’t process a claim if you were an independent contractor, worked for the State of Indiana, were an owner or partner in the business, or the employer has no Indiana location [5].

2. Go to court. Under Indiana’s wage payment law, an employer that pays late or withholds wages owes the wages, plus a reasonable fee for your lawyer and court costs. If the court finds the employer didn’t act in good faith, it must order the employer to pay two times the wages due [4]. For smaller amounts, small claims court can be an option.

3. File a federal complaint. Because most Indiana jobs are covered by the federal minimum wage law, you can also contact the U.S. Department of Labor’s Wage and Hour Division [7].
